CALIFORNIA TRAFFIC TICKETS & MOVING VIOLATIONS, FAQ

Question:
I just got pulled over, what should I do?

Answer:
When you are stopped by an officer for a possible vehicle code violation, BE COURTEOUS and keep both hands on the steering wheel where the officer can clearly see them. NEVER ARGUE with the officer. You will regret it if you decide to go to trial. The officer will make notes and will use that evidence against you in trial. The best thing to do is be polite and courteous. After all you want the officer to forget the facts of your case.

Question:
What is a citation or ticket?

Answer:
A traffic ticket or is citation is a summons to a person who is charged with a possible violation while operating a motor vehicle. You must sign it or the officer can take you to jail. You may be required to show up in court on or before a determined date set by the law enforcement officer.

Question:
Why do I have to sign the ticket?

Answer:
Signing the ticket does not mean you are guilty of that violation. By signing the ticket, you are promising to apear in court on or before the determined date on the ticket. If you do not sign the ticket you can be arrested and taken into custody.

Question:
What happens next?

Answer:
You may or may not recieve a notice from court to pay the fine or trial bail. You may need to appear in court in front of a judge. Check with the county if you did not recieve a notice. If you decide to fight your ticket, you have to post bail and show up for the court trial and enter a plea in front of a judge.

Question:
Can I go to traffic school?

Answer:
In the state of California, you are eligible to attend traffic school once every 18 months for a vehicle violation with one point. You may elect to fight the case with a Trial by Declaration before thinking about using up your traffic school option.

Question:
Can I Set Aside a DMV Point?

Answer:
The chances are excellent that you can get rid of an old dmv point that is hurting your license or insurance rates.

Question:
Should I fight my ticket?

Answer:
The first thing you want to do is to get some good advice from an experienced specialist lawyer who handles traffic tickets exclusively. His answer is going to be by all means fight that ticket. There is too much at stake with your DMV driving Record and Insurance premium rates and possibly you job might be at stake.

Question:
Should I represent myself?

Answer:
Absolutely not. You know nothing about the law and the court rules of evidence. The officer will be able to convict you with his testimony and most of what he says should not be considered by the court, but you won’t know how to object to his testimony. You will not know how to cross examine the officer or even what you should be objecting to. You are in a court of law and no nothing about it. Do not represent yourself, unless you have no other choice. Find a way, negotiate with a good traffic lawyer so you can protect your driving record and insurance rates.

Question:
How many DMV points before my license is suspended.

Answer:
If you get 4 points against your license in 12 months, the DMV can suspend your license or put you on probation for 6 months.

Question:
How many points is the average ticket?

Answer:
Most moving violations are one point each. Reckless driving and driving over 100 mph are two point violations, plus other penalties.
