The Trial by Declaration is prepared and along with the trial bail, is filed with the court. The officer is sent an Officer’s Declaration to fill out and return within thirty days. If he fails to do so, the case against you is dismissed. If the officer has no memory of the ticket, the case is dismissed.

If the TBD is not successful, you still have the right to a court trial, if the officer does not show up at trial you will win. If the officer does show up you can ask for traffic school before the trial starts and the judge will say yes.

If you are not eligible for trial you can use the law defenses in the TBD that I have sent you a copy of to fight your own case. You will have powerful law defenses to win the case. I will bring you up to speed on how to use the defenses.

I will also provide you with a legal form to file that will get rid of a bad judge (170.6 CCP form). You will know the law that makes all the difference. The judge and officer will be shocked at your competence.
