Fighting traffic tickets is always a good idea. That is especially true if you hire a traffic ticket lawyer who specializes in using law defenses to win cases. That’s what I do. I recommend that you fight your traffic ticket too.
Often I hear people talking about just paying the ticket, just so they don’t have to bother with it. That is a very bad idea. When you plead guilty the court charges you with a point against your DMV record and your insurance company can and will increase your insurance premium. The average increase is about an increase of $1800 over the next three years. If you should get a 2nd point within 12 months, now you have a really big hike in your rate and you would have difficulty even getting insurance with a new company with two points in 12 months.
How about going to traffic school? Well that has some advantages, but you don’t want to use up that option unless it really makes sense. Here’s why. You can only go to traffic school once every 18 months, so save the option and do the following.
File a Written Trial by Declaration (TBD) on a new ticket and see if you can win the case and save the traffic school. Even if you lose the TBD, you still can have a court trial and if the officer fails to appear you win. If the officer shows up, you ask for traffic school before the trial starts and the judge will say yes.
Now, if you had hired me to prepare the TBD, your chances of winning are much greater and my fee is only $400 to prepare the TBD with powerful law defenses….I really know what to do! If the case is won with the TBD because of all my law defenses in it, or because the officer failed to file his response to the TBD, you win.
If the TBD is no successful (because the judge refused to follow the law in my defenses), then I file the request for a court trial and you go to the court trial. If the officer fails to show up, you win. If he does show up, you can use my great law defenses on the judge (it will be different judge) or you can elect to go to traffic school before the trial starts.
You also have the option of having me go to trial for you and now you have a really great chance to win because I file all kinds of written law motions, I subpoena records to use in your defense and I use my very experienced court generalmanship to win the case.
Just a word about Trial by Declarations. I use powerful statement of facts with law cases and statutes. I file a special memorandum of law to dismiss the case on the legal grounds that the officer’s TBD declaration is not admissible in a court of law. I have a solid basis for the motion to dismiss based on evidentiary grounds.
The good news is that if you get a ticket there are great reasons for fighting that ticket because of all the powerful law defenses that I know how to use and because you want to avoid that DMV point, keep your insurance premiums down and sometimes keeping your job is involved.
